Terms of Service

By creating an account or using the Service, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Immediately notify us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

BetaFlow offers both free and paid subscription plans. For paid plans:

• You agree to pay all fees associated with your selected plan in accordance with the pricing and billing terms presented at the time of purchase
• Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you choose
• All fees are non-refundable except as expressly set forth in these Terms or as required by applicable law
• We reserve the right to change our pricing with 30 days' prior written notice; price changes will take effect at the start of your next billing cycle
• If payment fails, we may suspend access to paid features until the payment issue is resolved

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will continue to have access to paid features until then.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to the Service, other accounts, or any computer systems or networks connected to the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for any form of unauthorized data collection, scraping, or mining
• Transmit any viruses, worms, malware, or other malicious code
• Use the Service to send unsolicited commercial communications (spam)
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending access, and reporting violations to law enforcement.

Our Property: The Service, including its design, features, code, and documentation, is owned by BetaFlow and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

Your Content: You retain ownership of all content you create, upload, or transmit through the Service (“Your Content”). By using the Service, you grant us a limited, non-exclusive, worldwide license to use, store, and process Your Content solely for the purpose of providing and improving the Service. We will not sell Your Content or use it for advertising purposes.

AI-Generated Content: Content generated by our AI features is produced based on your inputs and project data. You own the AI-generated outputs created within your workspace. We do not use Your Content or AI outputs to train third-party AI models.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BETAFLOW, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination:

• Your right to access and use the Service will immediately cease
• We will delete or anonymize your personal data within 90 days, except where retention is required by law
• Any outstanding fees owed prior to termination remain payable
• Provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnity, and limitations of liability

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms or if we determine, in our sole discretion, that your use of the Service poses a risk to the platform, other users, or third parties.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

If you do not agree to the revised Terms, you must stop using the Service and close your account before the changes take effect.

These Terms shall be governed by and construed in accordance with the laws of Bosnia and Herzegovina, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be resolved in the courts located in Sarajevo, Bosnia and Herzegovina.
